Asky Labs AB - Terms of Use
Last updated: 25 October 2026 | Version: 1.0
These Terms of Use (the "Terms of Use") govern your access to and use of: (a) our website at https://askylabs.com/ and any other website, page or online channel that we operate and that links to these Terms of Use (the "Website"); and (b) where you access it as an individual user, the Asky platform (the "Platform" and, together with the Website, the "Sites").
The Sites are operated by Asky Labs AB ("Asky", "we", "our" or "us"), a company incorporated in Sweden with Org Nr. 559581-5852.
In these Terms of Use, "you" and "your" mean the person accessing or using the Sites. If you access or use the Sites on behalf of a business or other organisation, you also accept these Terms of Use on its behalf, and "you" includes that organisation.
Important: if your organisation has subscribed to the Asky service (the "Service"), its use of the Service is governed by our Terms of Service, together with the subscription plan and data processing agreement referred to in them (together, the "Customer Terms"). These Terms of Use do not replace the Customer Terms and, if they conflict, the Customer Terms prevail. Section 9 (Our Liability) excludes and limits our liability to you. Please read it carefully.
1. Acceptance of these Terms of Use
1.1 Website. By accessing or using the Website, you agree to these Terms of Use. If you do not agree, you must not use the Website.
1.2 Platform. If you are invited to the Platform, we will ask you to accept these Terms of Use when you first sign in, and again if we make a material change to them. You may not access the Platform unless you have done so.
1.3 Other terms. The following also apply to your use of the Sites: (a) our privacy notice (the "Privacy Notice"), which explains how we process personal data and how we use cookies on the Sites; and (b) where your organisation is a Customer, the Customer Terms.
1.4 Business service. The Service is designed for, and offered only to, businesses. If you visit the Website as a consumer, nothing in these Terms of Use affects the rights you have under the mandatory consumer protection laws of the country in which you live.
2. Relationship with the Customer Terms
2.1 Customers. The Service is available only to businesses that have accepted the Customer Terms (each a "Customer") and to the individuals they authorise. These Terms of Use do not give you or your organisation any right to use the Service.
2.2 Authorised Users. If a Customer has invited you to its workspace on the Platform (for example, as one of its employees or as an individual at an agency, consultant, contractor or client of the Customer), you are an "Authorised User" under the Customer Terms. As an Authorised User:
(a) you may use the Platform only for the Customer's business purposes, within the permissions the Customer has given you, and in accordance with these Terms of Use and the Customer Terms;
(b) you act on behalf of the Customer, and any instruction, authorisation or approval you give through the Platform (including any authorisation for the Platform to take automated actions, such as sharing insights, publishing content or implementing changes to a website) is treated as given by the Customer, and we may rely on it without further enquiry;
(c) you must have the Customer's authority, and, where you connect any website, account or system to the Platform, the authority of its owner, for everything you do on the Platform;
(d) the Customer may change or remove your access at any time, and your access ends automatically when the Customer removes you or its subscription ends; and
(e) these Terms of Use do not oblige us to provide the Service to you. Rights and remedies in relation to the Service belong to the Customer under the Customer Terms, and the Customer is responsible to us for your use of the Platform.
2.3 Agencies and their clients. Some Customers are agencies that use the Service for the brands of their own clients. If you have been given access to the Platform by an agency as an individual at one of its clients, the agency (and not us) is responsible to you and your organisation for the services it provides, including any outputs it shares with you. We have no contract with, and assume no duty of care to, an agency's clients.
2.4 Partners. Some businesses promote the Service or introduce customers to us under an agreement with us (each a "Partner"). Partners are independent businesses and are not our agents. A Partner cannot make any commitment, representation or warranty on behalf of Asky, and any statement by a Partner about the Service that is not set out in the Customer Terms does not bind us.
3. Your Account
3.1 You must give us accurate information when you register for, or are invited to, the Platform, and keep it up to date.
3.2 You must keep your login credentials confidential and must not share them with, or allow them to be used by, anyone else. You must tell us (at [email protected]) and, where applicable, the Customer immediately if you become aware of, or suspect, any unauthorised use of your account or any security breach.
3.3 We may refuse, suspend or withdraw your access to the Platform at any time, including where we reasonably suspect a security risk, misuse of the Sites or a breach of these Terms of Use, or that you are associated with a competitor of Asky.
4. Acceptable Use
4.1 You may use the Sites only for lawful purposes and in accordance with these Terms of Use. You must not, and must not attempt to or help anyone else to:
(a) use the Sites in any way that breaches any applicable law or regulation, or that is fraudulent or has any unlawful or fraudulent purpose or effect;
(b) access, monitor, copy or extract any part of the Sites or their content using any robot, spider, scraper, crawler or other automated means, except for search engine indexing of the Website in line with our robots.txt file, or as we expressly allow in writing;
(c) use the content of the Website, or the software, interfaces or documentation of the Platform, to train, fine-tune or develop any artificial intelligence or machine-learning model, or to build or offer a product or service that competes with the Service;
(d) reverse-engineer, decompile, disassemble or otherwise attempt to derive the source code of any software on the Sites, except to the extent that applicable law expressly permits this despite this restriction;
(e) gain or attempt to gain unauthorised access to the Sites, the servers on which they are stored or any server, computer or database connected to them, probe, scan or test their vulnerability, or breach or circumvent any security or authentication measure;
(f) attack the Sites by a denial-of-service or distributed denial-of-service attack, or otherwise interfere with or disrupt their operation or place an unreasonable load on their infrastructure;
(g) knowingly introduce any virus, trojan, worm, logic bomb or other material that is malicious or technologically harmful;
(h) upload, submit or share through the Sites any content that is unlawful, defamatory, infringing, deceptive, misleading, obscene or offensive, or that contains personal data you are not entitled to share;
(i) impersonate any person, or misrepresent your identity, your affiliation with any person, or your authority to act for a Customer or for the owner of any website, account or system;
(j) use the Sites in a way that breaches the terms of use of any third-party platform (including any AI platform), or that circumvents any technical or contractual restriction of such a platform; or
(k) frame or mirror any part of the Sites, or remove or obscure any proprietary notice on them.
4.2 Breach of this Section 4 is a material breach of these Terms of Use. We may take any action we consider appropriate, including suspending or withdrawing your access to the Sites and reporting the breach to the relevant authorities.
5. Intellectual Property
5.1 We or our licensors own all intellectual property rights in the Sites and their content, including the software, text, graphics, designs, logos and documentation, but not any data that a Customer provides through the Platform or any outputs generated for a Customer, which are governed by the Customer Terms. All such rights are reserved.
5.2 You may view, download and print pages of the Website for your own information or for the internal business purposes of your organisation, provided that you do not modify them and you keep all copyright and other proprietary notices. You must not otherwise use any part of the content of the Sites for commercial purposes without a licence from us.
5.3 Asky and our logos are our trade marks. Nothing in these Terms of Use gives you any right to use them. Any such right must be granted in writing, for example in an agreement with a Partner.
6. Information on the Sites and AI-Generated Content
6.1 General information only. The content on the Website is provided for general information only. It is not legal, marketing, financial or other professional advice on which you should rely. Although we make reasonable efforts to keep the Website up to date, we do not represent, warrant or guarantee that its content is accurate, complete or current.
6.2 AI-generated content. The Sites use artificial intelligence, including third-party large language models, to generate content, analyses and recommendations ("AI Content"). AI Content is generated by probabilistic systems and may be inaccurate, incomplete, out of date or unsuitable for your purposes, may infringe third-party rights, and may differ for the same query at different times. AI Content does not reflect our views. You are responsible for reviewing and verifying any AI Content before you rely on, publish or implement it.
6.3 Service outputs. Where AI Content is generated for a Customer through the Service, it is an output under the Customer Terms, and the Customer Terms (and not this Section 6) apply to it.
7. Free Tools and Trials
7.1 We may make tools, demonstrations, reports or other features available on the Website free of charge, with or without registration (for example, a free check of a brand's visibility in AI-generated responses) ("Free Features"). Free Features are provided for evaluation only, and we may change, suspend or withdraw them at any time without notice.
7.2 You are responsible for the information you submit to a Free Feature, and you must not submit any confidential information or any personal data other than your own business contact details.
7.3 Any free trial of the Service is provided under, and governed by, the Customer Terms.
8. Information You Submit to Us
8.1 Submissions. If you send us information through the Sites (for example, through a contact, demo-request or sign-up form) ("Submissions"), you must ensure that it is accurate and that you are entitled to provide it. We will use any personal data in a Submission in accordance with our Privacy Notice. You grant us a non-exclusive, worldwide, royalty-free licence to use the rest of each Submission to respond to you and to operate, provide and improve the Sites.
8.2 Feedback. If you give us feedback, suggestions or ideas about the Sites or the Service ("Feedback"), you grant us an unrestricted, perpetual, irrevocable, worldwide, royalty-free licence to use and commercialise it without compensation or attribution. Feedback does not include any data that a Customer provides under the Customer Terms.
8.3 Aggregated data. We may aggregate and anonymise Submissions, information you provide through Free Features and data about your use of the Sites, so that the resulting data does not identify, and cannot by any means reasonably likely to be used be linked to, you, your organisation, any other individual or any brand, product or business. We own that data and may use, disclose, sell, license and otherwise commercialise it for any purpose, but we will not use it, or permit any third party to use it, to train, fine-tune or improve any AI model. Data generated through a Customer's use of the Service is governed by the Customer Terms.
9. Our Liability
9.1 Liability not excluded. Nothing in these Terms of Use excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under applicable law.
9.2 Business users. If you use the Sites for purposes relating to your trade, business, craft or profession, then, subject to Section 9.1:
(a) the Sites and their content (including AI Content and Free Features) are provided "as is" and "as available", and we exclude all conditions, warranties, representations and other terms, whether express or implied, that might otherwise apply to them;
(b) we will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if foreseeable, arising under or in connection with your use of, or inability to use, the Sites, or your use of or reliance on any content on them; and
(c) in particular, we will not be liable for any loss of profits, sales, business or revenue, business interruption, loss of anticipated savings, loss of business opportunity, goodwill or reputation, loss or corruption of data, or any indirect or consequential loss or damage.
9.3 Customers and Authorised Users. If your organisation is a Customer, or you are an Authorised User, our liability in connection with the Service is governed only by the Customer Terms and is owed only to the Customer. To the fullest extent permitted by law, we have no liability to you personally in connection with the Service.
9.4 Consumers. If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms of Use or our failure to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. We provide the Website for information purposes only, and we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
9.5 Viruses. We do not guarantee that the Sites will be secure or free from bugs or viruses. You are responsible for configuring your own technology to access the Sites and should use your own virus protection software. To the extent permitted by law, we will not be liable for any loss or damage caused by a virus, denial-of-service attack or other technologically harmful material that may infect your equipment, programs or data because of your use of the Sites or of any website linked to them.
9.6 Benefit of exclusions. The exclusions and limitations in this Section 9 also apply for the benefit of Asky's group companies, officers, directors, employees, agents, contractors and subprocessors, who may rely on them.
10. Indemnity
10.1 If you use the Sites on behalf of a business or other organisation, that organisation will indemnify us against all third-party claims, and related losses, costs and expenses (including reasonable legal fees), arising out of any breach of Section 4 (Acceptable Use) by you. Where your organisation is a Customer, the indemnities in the Customer Terms also apply.
11. Availability, Changes and Links
11.1 Availability. We do not guarantee that the Sites, or any content on them, will always be available or uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the Sites for business and operational reasons. Where your organisation is a Customer, the availability of the Service is governed by the Customer Terms.
11.2 Changes to the Sites. We may update and change the Sites from time to time.
11.3 Third-party links. Where the Sites contain links to websites or resources provided by third parties (including AI platforms), those links are provided for your information only. We have no control over, and accept no responsibility for, those websites or resources or any loss or damage that may arise from your use of them.
11.4 Linking to the Website. You may link to our home page, provided that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not link to the Website in a way that suggests any form of association with, or approval or endorsement by, us where none exists (and a Partner may do so only as permitted by its agreement with us). We may withdraw this permission without notice.
12. Suspension and Termination
12.1 We may suspend or end your access to all or any part of the Sites at any time, without notice, if you breach these Terms of Use, or if we reasonably consider it necessary to protect the Sites, their other users or us.
12.2 Sections 5, 6, 8, 9, 10, 14 and 15, and any other provision that by its nature should continue, survive the end of your access to the Sites.
13. Changes to these Terms of Use
13.1 We may update these Terms of Use from time to time. The version number and date at the top show when they were last updated. Please check these Terms of Use each time you use the Website so that you understand the terms that apply at that time.
13.2 We will tell Authorised Users about any material change (for example, by email or by a notice when they next sign in), and may ask them to accept the updated Terms of Use before they continue to use the Platform. Changes to the Customer Terms are made only in accordance with the Customer Terms.
14. Governing Law and Jurisdiction
14.1 Governing law. These Terms of Use, their subject matter and formation, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, are governed by the law of England and Wales.
14.2 Jurisdiction. Subject to Section 14.3, the courts of England and Wales have exclusive jurisdiction to settle any such dispute or claim, except that we may also bring proceedings in the courts of the country in which you are established. Either party may apply to any court of competent jurisdiction for interim or injunctive relief.
14.3 Consumers. If you are a consumer, you will also benefit from any mandatory provisions of the law of the country in which you live, and you may bring proceedings in the courts of that country.
15. General
15.1 Entire agreement. These Terms of Use, together with the documents referred to in them, are the entire agreement between you and us about their subject matter. They do not vary the Customer Terms.
15.2 Assignment. We may transfer our rights and obligations under these Terms of Use to another organisation. You may not transfer yours without our written consent.
15.3 Third-party rights. Except for the persons referred to in Section 9.6, who may enforce that Section, a person who is not a party to these Terms of Use has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of their terms.
15.4 Severability. If any provision of these Terms of Use is found invalid or unenforceable, it will be treated as deleted or modified to the minimum extent needed, and the rest of these Terms of Use will continue in force.
15.5 No waiver. If we do not insist on your compliance with any of these Terms of Use, or delay in doing so, that does not waive our rights.
15.6 Language. The English-language version of these Terms of Use is the binding version; any translation is for convenience only.
